Will I Be Deported Under a Trump Presidency (And Other Questions)?

As a Miami immigration lawyer, I have been receiving many inquiries from new and existing clients about what will happen with their immigration status, now that Trump is President-elect.

At this point in time, I must point out the prospects for a pro-immigrant administration are sadly dim. While it is still unclear what specific changes immigration policy will undergo under a Trump presidency, we do know that Trump’s recent appointment of Jeff Sessions as Attorney General and Trump’s own hardline stance against immigrants means that many immigrants have to take action now.

I am an undocumented immigrant. Will I be at increased risk of deportation under a Trump administration?
Unfortunately, myself and other Miami immigration lawyers are expecting mass deportation of individuals who do not have legal status. For this reason, I would encourage you to contact a Miami immigration lawyer immediately to see if there is anything that they can do to help you before Trump takes power.

I have DACA (Deferred Action for Childhood Arrival) status. Am I at risk when Trump becomes President?
As a Miami immigration lawyer, I have been encouraging individuals with DACA (deferred action for childhood arrivals) to contact our office to see if they have any possibility of acquiring a type of permanent status. For example, we may be able to apply for permanent resident status for individuals who are married to U.S. citizens or lawful permanent residents. It is important to note that DACA is not law — it was an executive order by  President Obama. As such, Trump could very easily do away with DACA as quickly as he so chooses. If you have any questions in regard to this, I would encourage you to contact a Miami immigration lawyer at your earliest convenience.

I am married to a lawful permanent resident or a U.S. citizen, but I entered the United States illegally, and am currently in the country as an undocumented immigrant. What are my options under a Trump presidency?
You could be eligible for a waiver which would ultimately result in permanent residence in the U.S. However, it is essential that you contact a Miami immigration lawyer to see if you are eligible. If you are eligible, I would encourage you to apply as soon as possible. Again, this special waiver is authorized by President Obama’s executive order —  not law — so it could be gone as soon as Trump takes power. I am a lawful permanent resident. What should I do the face of a Trump administration?
I would encourage lawful permanent residents to apply for their U.S. Citizenship. This will allow you to vote in the next election and could potentially benefit any relatives who need immigration status as well. How is the landscape of immigration policy going to change under a Trump presidency?
